FortisAlberta is committed to a high standard of professional conduct in all our dealings with our stakeholders, including our customers, retailers, and the AUC.

As a regulated electric distribution utility, we must conduct our business in accordance with a number of specific and general rules and codes. Two codes of conduct govern the way in which FortisAlberta works and interacts with other industry participants: the Code of Conduct Regulation and the Inter-Affiliate Code of Conduct.

Code of Conduct Regulation

The Code of Conduct Regulation ensures that we are fair, open and transparent in all our dealings with retailers and customers.

The Code of Conduct Regulation requires that:

  • retailers and customers have equal access to regulated services;
  • distribution companies protect the confidentiality of customer information;
  • retailers have equal access to information disclosed by distribution companies;
  • customers are treated fairly by affiliated retailers; and
  • the revenue from the provision of regulated services will not subsidize affiliated, deregulated retail services.

In addition, the Code of Conduct Regulation is intended to:

  • further the development of the competitive electricity markets in Alberta;
  • foster fair competition for all participants in those electricity markets; and
  • benefit customers by enabling owners and their affiliated retailers to pursue practices that create cost efficiencies in their operations and that do not create an unfair advantage.

We have implemented a Code of Conduct Compliance Plan that details the measures, policies, procedures and monitoring mechanisms that we will employ to ensure our full compliance with the Code of Conduct Regulation.

This code is enforced by the Alberta Utilities Commission (AUC) to monitor this regulation. Any concerns or questions regarding FortisAlberta in respect of non-compliance with the Code of Conduct Regulation or the Code of Conduct Compliance Plan should be made to FortisAlberta’s Compliance and Privacy Officer and to the AUC.

The Code of Conduct Regulation governs aspects of Alberta’s retail electricity and natural gas market and is intended to create a level playing field for Retailers, while at the same time ensuring that Customers and Customer Information are adequately protected. 

Any person that feels that FortisAlberta has failed to conduct its business in accordance with the Code of Conduct Regulation may submit a complaint to the Alberta Utilities Commission at consumer-relations@auc.ab.ca or by phoning 1-780-427-4903 or to the Market Surveillance Administrator at compliance@albertamsa.ca or by phoning 1-403-705-3181. The Alberta Utilities Commission and the Market Surveillance Administrator are independent of FortisAlberta and EPCOR Energy Alberta GP Inc.

Inter-Affiliate Code of Conduct

As a subsidiary of Fortis Inc., FortisAlberta is part of the Fortis Inc. Group of Companies, which is comprised of several regulated utilities. From time to time, we engage in transactions with some of our affiliates in order to identify possible cost advantages or other benefits that permit us to increase our operational efficiencies.

The Inter-Affiliate Code of Conduct ensures that all transactions between FortisAlberta and our affiliates are conducted in a fair, open and transparent manner.

The key objectives of the Inter-Affiliate Code of Conduct are:

  • preventing cross subsidization between utilities and their affiliates;
  • protecting confidential customer information collected in the course of business;
  • ensuring that a utility’s affiliates and the affiliates’ customers do not have preferential access to services; and
  • preventing uncompetitive practices between utilities and their affiliates which would be detrimental to the interests of the utilities’ customers.

The Inter-Affiliate Code of Conduct and the Compliance Plan have both been approved by the Alberta Utilities Commission (AUC).

FortisAlberta performs an annual review of our compliance with the Inter-Affiliate Code of Conduct and the Compliance Plan and we file an annual report with the AUC that summarizes the results of that review.
